  17. INSTALLATION INSTRUCTIONS

  19. To Install this CD run SETUP.EXE in the root directory 
  20. from the Windows 3.1 Program Manager.
  21.  
  22. If you do not have Video for Windows 1.1 installed on your machine
  23. you will need to also run the SETUP.EXE program located in the
  24. VFW sub-directory.

  29. SOFTWARE LICENSE AGREEMENT - Please Read Carefully Before Continuing
  30.  
  31. We're very sorry about having to put this harsh-sounding legal
  32. gobble-de-gook here.  But, our lawyer insists.  We pay him a 
  33. LOT of money, so we listen to him...  much to our chagrin.
  34.  
  35. This CD-ROM contains SOFTWARE from Advanced Multimedia Solutions, Inc.
  36. ("AMS").  The SOFTWARE is licensed to you ("SUBLICENSEE") only on the
  37. condition that you have complied with and agree with the following
  38. terms and conditions.  IF YOU DO NOT AGREE WITH OR COMPLY WITH THESE
  39. TERMS AND CONDITIONS, RETURN THE UNINSTALLED SOFTWARE AND ALL OF THE
  40. ACCOMANYING ITMS (including documentation and packaging) TO THE PLACE
  41. YOU OBTAINED THEM FOR A FULL REFUND.
  42.  
  43. AMS hereby grants to SUBLICENSEE and SUBLICENSEE accepts a perpetual,
  44. non-transferable, non-exclusive license to use the SOFTWARE subject
  45. to the terms and conditions set forth below.
  46.  
  47.    A. Title and ownership rights in the SOFTWARE are and shall at all
  48.       times remain with AMS and Ballantine Books.  AMS warrants that
  49.       it has the right to grant the sublicense granted herein.  
  50.       SUBLICENSEE may not sublicense, assign, or transfer the
  51.       license or the SOFTWARE.  Any attempt to sublicense, assign,
  52.       or transfer any of the rights, duties, or obligations hereunder
  53.       will result in termination of the sublicense.
  54.  
  55.    B. SUBLICENSEE shall not distribute, sublicense, or lease the
  56.       SOFTWARE or documentation, or use the SOFTWARE in a network,
  57.       time-sharing, multiple CPU, or multi-user environment.
  58.  
  59.    C. SUBLICENSEE shall not copy, modify, alter, adopt, adapt, or
  60.       transfer, in whole or in part, the software or documentation
  61.       provided by AMS hereunder.
  62.  
  63.    D. Upon any termination of the sublicense, SUBLICENSEE agrees to
  64.       return to AMS at the address below, or to destroy, the
  65.       SOFTWARE and documentation along with all copies any any
  66.       form thereof and to provide to the address below an affidavit
  67.       of destruction.
  68.  
  69.    E. AMS warrant that (a) the SOFTWARE will perform substantially
  70.       in accordance with the accompanying written materials and
  71.       (b) the SOFTWARE is properly recorded on the CD media.  This
  72.       Warranty extends for ninety (90) days from the date of
  73.       purchase.  There is no warranty after expiration of the
  74.       warranty period.
  75.  
  76. THERE ARE NO OTHER WARRANTIES.  AMS DISCLAIMS ALL OTHER WARRANTIES,
  77. EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED
  78. WARRANTIES OF MERCHANTABILITY, OF FITNESS FOR A PARTICULAR PURPOSE,
  79. AND ARISING FROM USAGE OF TRADE OR COURSE OF DEALING OR 
  80. PERFORMANCE, WITH RESPECT TO THE SOFTWARE, THE ACCOMPANYING WRITTEN
  81. MATERIALS.

  83. EXCEPT AS STATED HEREIN, IN NO EVENT SHALL AMS OR ITS SUPPLIERS BE
  84. LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER BASED ON CONTRACT, TORT,
  85. WARRANTY OR OTHER LEGAL OR EQUITABLE GROUNS, INCLUDING WITHOUT
  86. LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS
  87. INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY,
  88. ARISING OUT OF THE USE OF OR INABILITY TO USE THIS AMS SOFTWARE
  89. PRODUCT, EVEN IF AMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  90. LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE
  91. LIMITION MAY NOT APPLY TO YOU.

  93. AMS's entire liability and your exclusive remedy shall be at AMS's
  94. option, either (a) return of the price paid for the SOFTWARE or
  95. (b) repair or replacement of the SOFTWARE that does not meet
  96. AMS's limited Warranty and which is returned to AMS with a
  97. copy of your receipt.  This Limited Warranty is void if failure
  98. of the SOFTWARE has resulted from accident, abuse, or misapplication.
  99. Any replacement SOFTWARE will be warranted for the remainder of
  100. the original period or thirty (30) days, whichever is longer.  In
  101. no event shall AMS's liability exceed the purchase price of the
  102. SOFTWARE.
  103.  
  104. This Agreement is governed by the laws of the State of Washington.
